TYLER, Texas (KLTV) – The Supreme Court of Texas has overruled the Texas Court of Criminal Appeals by ordering a temporary stay of execution. Robert Roberson will not be executed on Thursday night.

Roberson did not make a public statement, but according to the communications director for the Texas Department of Criminal Justice, he was shocked. He praised God, and then thanked all those who were there supporting him.

Roberson’s attorney Gretchen Sween sent the following statement after the temporary stay:

The vast team fighting for Robert Roberson–people all across Texas, the country, and the world–are elated tonight that a contingent of brave, bipartisan Texas lawmakers chose to dig deep into the facts of Robert’s case that no court had yet considered and recognized that his life was worth fighting for. He lives to fight another day and hopes that his experience can help improve the integrity of our criminal legal system. Thank you to all who have supported Robert, an innocent man on Texas’s death row.”

The Texas Court of Criminal Appeals had ruled earlier Thursday evening against the Texas House effort to subpoena an East Texan who has been scheduled to be executed Thursday night. Those working on behalf of Roberson appealed to the Supreme Court of Texas.

Roberson, 59, of Palestine, who was sentenced in 2003 for the 2002 death of his young daughter, was set to be put to death Thursday. Roberson has long claimed to be innocent, and has garnered the support and advocacy of people across the country who believe his conviction to have been unfounded, as it was claimed she died of shaken baby syndrome, which has now been disproven; examiners now say she died of pneumonia.

Little time is left for those working on behalf of Roberson, believing he is innocent based on new information in his daughter’s cause of death, to achieve clemency for him. That led those legislators to ask the Texas Supreme Court to intervene on Roberson’s half. Governor Abbott has not weighed in, at least publicly, at this point.

A Travis County judge had earlier Thursday issued a ruling to block the execution of Roberson. This was the ruling the court of appeals ruled against at around 8 p.m. The execution warrant expires at midnight.

UPDATE: Live From Huntsville Robert Roberson Update

Rep. Jeff Leach, chairman of the House Committee on Judiciary & Civil Jurisprudence, subpoenaed Roberson in a bid to keep him from being executed this week. The subpoena is regarding the new science behind so-called shaken baby syndrome and other factors in the case.

Judge Jessica Magrum of Travis County granted the request Thursday afternoon that Roberson can be subpoenaed to testify before a panel of Texas legislators next week, effectively pressing a pause button on Roberson’s execution on Thursday night, though the attorney general will appeal.

Texas Department of Criminal Justice Communications Director Amanda Hernandez confirmed to KLTV that as long as things are still pending in the court system, like this temporary restraining order due to the subpoena, the execution will not take place Thursday. The execution warrant is good through midnight on Thursday, however.

Rep. Lacey Hull (R-Harris) and Rep. John Bucy (D-Williamson) were at the prison Thursday night, advocating for Roberson’s life to be spared.

Roberson’s lawyers waited to see if Abbott would grant Roberson a one-time 30-day reprieve. It’s the only action Abbott can take in the case as the Texas Board of Pardons and Paroles on Wednesday denied Roberson’s clemency petition.

The board voted unanimously, 6-0, to not recommend that Roberson’s death sentence be commuted to life in prison or that his execution be delayed. All members of the board are appointed by the governor. The parole board has recommended clemency in a death row case only six times since the state resumed executions in 1982.

In his nearly 10 years as governor, Abbott has halted only one imminent execution, in 2018 when he spared the life of Thomas Whitaker, whose father had asked that his son not be put to death. The father had survived a shooting that Whitaker had masterminded, according to the Associated Press.

As it stands at midnight on Thursday, Roberson will live to answer the subpoena to appear before the Texas House on Monday, where his case’s details in light of new “junk science” wording that may be applied to his case. Until then, he is being taken back to Livingston to his death row cell.

An unusual legal move bought more time for a Texas man who was set to be executed on Thursday evening.

A bipartisan group of Texas lawmakers, who said Robert Roberson was actually innocent and shouldn’t be executed, issued a subpoena for the death row inmate.

Roberson was convicted of the capital murder of his 2-year-old daughter in 2002. Prosecutors said she died from shaken baby syndrome but new evidence showed she died from pneumonia and not abuse. That new evidence was not considered in any of his rejected appeals.

“For over 20 years, Robert Roberson has spent 23.5 hours of every single day in solitary confinement in a cell no bigger than the closets of most Texans, longing and striving to be heard. And while some courthouses may have failed him, the Texas House has not.” said Texas Reps. Jeff Leach (R-Plano) and Joe Moody (D-El Paso) in a joint statement.

The lawmakers said they subpoenaed Roberson to hear his testimony on Texas capital punishment. Roberson was scheduled to testify on Monday, Oct. 21, several days after the scheduled execution of 6 p.m. Thursday.

Just 90 minutes before the death warrant was to be carried out, a Travis County judge presided over a court hearing to decide which carried more weight and should be honored — a Texas legislative subpoena or a death warrant for execution.

Judge Jessica Mangrum granted a temporary restraining order to prevent the execution. This began a night of legal limbo for Roberson.

The state, intent on going through with the execution, succeeded in having Mangrum’s restraining order overruled by the Texas Criminal Court of Appeals.

The lawmakers then appealed to the Texas Supreme Court, arguing their effort to subpoena Roberson was a civil matter. The state’s highest court agreed.

“Whether the legislature may use its authority to compel the attendance of witnesses to block the executive branch’s authority to enforce a sentence of death is a question of Texas civil law, not its criminal law,” wrote Justice Evan Young.

“Must the executive yield if the legislature invokes its authority — that is, would proceeding with an execution in these circumstances entail the executive branch’s intrusion into the broad authority of the legislative branch?” Young continued. “Or, contrariwise, would allowing various committees of the legislature to subpoena an inmate who is subject to an impending death sentence constitute the legislative branch’s intrusion into the orderly functioning of the law, risking manipulation of the judicial process and the executive function?”

The Supreme Court left it to the Travis County District Court to resolve the separation of powers issue.

It remained unclear when a new execution date would be scheduled. The death warrant for Roberson expired at midnight Friday.

Meanwhile, Roberson, who has been on death row for 22 years, will live another day.

“We’re deeply grateful to the Texas Supreme Court for respecting the role of the Texas legislature in such consequential matters,” said Leach and Moody. “We look forward to welcoming Robert to the Texas Capitol, and along with 31 million Texans, finally giving him — and the truth — a chance to be heard.”

BOSTON (AP) — The family of Ethel Kennedy, the widow of Robert F. Kennedy, says she’s been hospitalized after suffering a stroke.

In a statement on X posted Tuesday night by her daughter Kerry Kennedy, the family said it happened Thursday morning in her sleep and that she was brought to a hospital where she was receiving treatment and resting comfortably. They did not identify the hospital, nor where she suffered the stroke.

“She is comfortable, she is getting the best care possible and she is surrounded by family,” the statement said. “She is, as you know, a strong woman who has led a remarkably fulfilling life. We are looking after her.”

The 96-year-old matriarch is one of the last remaining members of the extended family’s generation that included President John F. Kennedy.

“She has had a great summer and transition into fall,” the family statement said. “Every day she enjoyed time with her children, nieces, nephews, grandchildren, and great-grandchildren. She was able to get out on the water, visit the pier, and enjoy many lunches and dinners with family. It has been a gift to all of us and to her as well.”

For a generation of Americans, the Democratic Party clan represented the closest thing the U.S. had to the royalty it has always admired elsewhere. The JFK era was dubbed “Camelot” because the youthful president and his glamorous wife, Jacqueline Kennedy, evoked a sense of national optimism, expressed in a line from the Broadway musical.

She was by Robert F. Kennedy’s side when he was fatally shot in the kitchen of the Ambassador Hotel in Los Angeles on June 5, 1968, just after winning the Democratic presidential primary in California. Her brother-in-law, President John F. Kennedy, had been assassinated in Dallas less than five years earlier.

The Robert F. Kennedy Center for Justice and Human Rights, which she founded later in 1968, is dedicated to advancing human rights through litigation, advocacy, education and inspiration. The nonprofit also gives annual awards to journalists, authors and others who have made a significant contribution to human rights. She also was active in the Coalition of Gun Control, Special Olympics and the Earth Conservation Corps.

She remained socially active into her 90s, participating in a 2016 demonstration in support of higher pay for farmworkers in Florida and a 2018 hunger strike against the Trump administration’s immigration policies. She divided her time between homes in Hyannis Port, Massachusetts, and Palm Beach, Florida.

New York Jets fire coach Robert Saleh after 2-3 start and apparent tension with Aaron Rodgers

The New York Jets fired head coach Robert Saleh on Tuesday amid the team’s disappointing start to this season and apparent tensions with star quarterback Aaron Rodgers.

Defensive coordinator Jeff Ulbrich will be the team’s interim head coach, the Jets announced, as Saleh leaves Florham Park, New Jersey, with an overall record of 20-26 in a little more than 3¼ seasons at the helm.

“This morning, I informed Robert Saleh that he will no longer serve as Head Coach of the Jets,” team owner Woody Johnson said in a statement.

“This was not an easy decision but we are not where we should be given our expectations, and I believe now is the best time for us to move in a different direction.”

The team entered the season with high hopes and Rodgers’ return to the huddle after he missed nearly all of 2023 with a leg injury.

The Jets were blown out in the season opener by the San Francisco 49ers before they rebounded with wins over the woeful Tennessee Titans and the New England Patriots.

But the past two weekends have ended in frustrating losses, at home to the Denver Broncos and in London against the Minnesota Vikings.

In addition to the losing, there have also been perceptions of tension between Rogers and Saleh.

The Jets committed five false start penalties in the Denver loss, and Saleh said they could be linked to the tricky cadence Rodgers uses when he barks out pre-snap signals.

And in the win over New England, Rodgers appeared to rebuff an attempted hug from Saleh after a touchdown.

When he was hired, Saleh was celebrated as the first Muslim head coach of an NFL team. He was escorted out of team headquarters by the team’s security director, NBC Sports reported.

“We commend Coach Robert Saleh for making history as the first American Muslim head coach in NFL history,” the Council on American Islamic Relations, a Muslim civil rights organization, said in a statement Tuesday.

“Although no one should jump to conclusions about why the Jets fired Coach Saleh, the report that Jets security physically escorted Saleh out of the building does raise concerns about the possible motive for such unusual hostility.”

Rep. Jamaal Bowman, D-N.Y., called Saleh’s firing a “raw deal” and pinned the team’s poor fortunes on Rodgers, offensive coordinator Nathaniel Hackett, the front office and former QB Zach Wilson.

“Robert Saleh got a raw deal and Aaron Rodgers undermined him every step of the way,” Bowman posted on X. “This was downhill since @nyjets drafted Zach Wilson. Nathaniel Hackett is trash. Saleh kept the defense great through the toughest times. Raw deal.” 

Bowman also wondered out loud whether Saleh’s embrace of his Lebanese heritage could have played a role in this termination.

Although Saleh has worn a patch of the Lebanese flag on his in-game gear before, it drew new eyes Sunday in the wake of Israel’s ongoing attack on its northern neighbor.

Saleh, 45, joined the Jets after a successful four-season run as defensive coordinator of the 49ers.

“We are very proud of Robert and the achievements he made in his young career,” American-Arab Anti-Discrimination Committee Executive Director Abed Ayoub said in a statement.

“As the first Muslim Arab-American NFL head coach, he has paved the way for future talent in our community. We have no doubt that New York is not the last stop on his coaching and football journey. The community will always be there, cheering on his continued success and growth.”

Saleh is also the third coach in this past decade to be fired after his team lost in London.

The Oakland Raiders terminated Dennis Allen in 2014 after an 0-4 start and a loss to the Miami Dolphins at Wembley Stadium.

Miami fired Joe Philbin after his 1-3 Dolphins lost in 2015 to the Jets, also at Wembley.

The New York Jets have fired head coach Robert Saleh.

ESPN’s Adam Schefter first reported the news on Tuesday, just two days after the Jets’ 23-17 loss in London against the Minnesota Vikings, and the team later confirmed it.

Jeff Ulbrich, who was serving as defensive coordinator, has been named the interim head coach. Ulbrich, 47, has been the Jets’ DC since 2021 when Saleh was hired.

“This morning, I informed Robert Saleh that he will no longer serve as the head coach of the Jets,” team owner Woody Johnson said in a statement. “I thanked him for his hard work these past three-and-a-half years and wish him and his family well moving forward. This was not an easy decision, but we are not where we should be given our expectations, and I believe now is the best time for us to move in a different direction.

“Jeff Ulbrich will serve as our interim head coach for the remainder of the season. He is a tough coach who has the respect of the coaches and players on this team. I believe he along with the coaches on this staff can get thee most out of our talented team and attain the goals we established this offseason.”

Saleh spent over three seasons as the Jets head coach, going 20-36 and never finishing with a winning record (4-13 in 2021, 7-10 in 2022 and 2023). New York is 2-3 this season, just one game behind the Buffalo Bills in the AFC East with a Monday Night Football matchup looming in six days.

Schefter reported that Saleh had one year left on his contract, but the franchise was obviously determined to move on after two straight losses and an unproductive start to Aaron Rodgers’ tenure. The 40-year-old quarterback has seven touchdowns and four interceptions through five weeks, and his 81.6 passer rating is the worst of his career as a starter.

Despite boasting top-five defense in yardage in 2022, 2023 and 2024 (through five games), the Jets never figured out their quarterback situation under Saleh. The team started six different signal callers in his 56 games — Zach Wilson (33), Mike White (7), Rodgers (6), Joe Flacco (5), Trevor Siemian (3) and Tim Boyle (2).

After facing the Bills at home in Week 6, the Jets will hit the road for a Sunday Night Football game against the Pittsburgh Steelers.

Polish forward Lewandowski could have doubled his side’s lead before the break only to be denied by the visitors’ goalkeeper David Soria.

Soria was also on hand to tip a glorious effort from teenage sensation Lamine Yamal over the crossbar in the second half.

Yamal also hit the crossbar as he capitalised on a tiring Getafe defence and Barcelona skipper Raphinha also had chances to secure the points.

However, Barcelona will breathe a sigh of relief as they sit four points clear at the summit of La Liga.

Despite controlling possession Flick’s young side showed weaknesses in defence as they head to Osasuna looking to make it eight league wins on the bounce.

Meanwhile, Getafe have just four points to their name from seven matches but will be encouraged by another strong defensive performance.

Getafe have home games against Alaves and Osasuna when they will hope to pick up a first league win.

Robert Pattinson Dies Again and Again in ‘Mickey 17’ Trailer

The sci-fi comedy film was written and directed by Parasite filmmaker Bong Joon Ho

Robert Pattinson is sacrificing himself for science, literally, in the trailer for Bong Joon Ho‘s Mickey 17. In the clip, Pattinson plays a man named Mickey who volunteers to be an “expendable” and is subject to repeated deaths in a futuristic world.

The comedic trailer, which sees the British Pattinson doing an unusual American accent, shows Mickey forced to die in violent ways in the name of research, with his body replicated each time he kicks the bucket. Eventually, though, two Mickeys exist at once, causing both chaos and excitement.

The film, which also stars Naomi Ackie, Steven Yeun, Toni Collette, and Mark Ruffalo, marks Joon Ho’s highly-anticipated follow-up to his Oscar-winning drama Parasite. It’s based on the novel Mickey 7 by Edward Ashton and will arrive in theaters on Jan. 31, 2025.

The official synopsis notes, “From the Academy Award-winning writer/director of Parasite, Bong Joon Ho, comes his next groundbreaking cinematic experience, Mickey 17. The unlikely hero, Mickey Barnes (Robert Pattinson) has found himself in the extraordinary circumstance of working for an employer who demands the ultimate commitment to the job… to die, for a living.”

Joon Ho won three Oscars for Parasite, which came out in 2019, including Best Director. He previously helmed Okja, Snowpiercer, and The Host. Several of his longtime collaborators, including cinematographer Darius Khondji and editor Yang Jinmo, also worked on Mickey 17.

Pattinson most recently starred as Bruce Wayne in The Batman and lent his voice to the English-language dub of Hayao Miyazaki’s animated film The Boy and the Heron.

Robert Pattinson Leads Bong Joon Ho’s Sci-Fi Film

Warner Bros. has released the trailer for Bong Joon Ho’s “Mickey 17,” the long-awaited follow-up to the director’s best picture winner “Parasite.” Based on the 2022 novel “Mickey7” by Edward Ashton, the sci-fi thriller stars Robert Pattinson as an “expendable” employee named Mickey Barnes.

In the novel, Mickey is sent on dangerous missions to colonize an ice planet. When one version of Mickey dies, a duplicate is created to replace him that retains most of his memories.

Along with Pattinson, the cast includes Steven Yeun, Naomi Ackie, Toni Collette and Mark Ruffalo.

“Mickey 17” is directed and written by Bong, who also produces through his company Offscreen. Additional producers include Dede Gardner and Jeremy Kleiner of Plan B and Dooho Choi of Kate Street Pictures.

Warner Bros. has nudged “Mickey 17” a few times on its theatrical schedule, most recently bumping the film from a March 29, 2024, date to its current January 2025 slot. When the move was announced, sources told Variety that the decision was made to secure an Imax release window and allow more time to finish the project, which had been affected due to the Hollywood strikes and various production shifts.

“Mickey 17” is Bong’s first feature to be released following the massive success of his 2019 thriller “Parasite,” which followed a working-class Korean family that deceptively infiltrates the home of an affluent family. “Parasite” was the first foreign language film to win the Academy Award for best picture. The film also nabbed Oscars for original screenplay, director and international feature. Bong’s other notable films include “Snowpiecer,” “Okja,” “Memories of Murder,” “The Host” and “Mother.”

Pattinson recently starred in the title role of Matt Reeves’s “The Batman” in 2022, bringing a brooding sensibility to Bruce Wayne. His recent sci-fi credits include Christopher Nolan’s “Tenet” and Claire Denis’ “High Life.”

Robert F. Kennedy Jr. suspends his presidential bid, backs Trump • Maine Morning Star

Independent presidential candidate Robert F. Kennedy Jr. said Friday he is suspending his campaign and threw his support behind former President Donald Trump — the GOP presidential nominee.

The announcement from the environmental lawyer and anti-vaccine activist, who has held on to a long-shot presidential bid, comes just a day after Vice President Kamala Harris formally accepted her party’s nomination at the Democratic National Convention.

“It’s with a sense of victory and not defeat that I’m suspending my campaign activities,” Kennedy said in Phoenix, Arizona, during a lengthy news conference.

“Not only did we do the impossible by collecting a million signatures, but we changed the national political conversation forever,” he said, adding that “I can say to all who have worked so hard the last year-and-a-half — thank you for a job well done.”

Kennedy acknowledged that he “cannot, in good conscience, ask my staff and volunteers to keep working their long hours, or ask my donors to keep giving when I cannot honestly tell them that I have a real path to the White House.”

He clarified that he is not terminating his campaign and that his name will “remain on the ballot in most states.”

The third-party candidate said he would remove his name from the ballot in about 10 battleground states “where my presence would be a spoiler.” He did not specify the states.

He said voters who live in a blue state can vote for him “without harming or helping (former) President Trump or Vice President Harris.”

In response, Trump thanked Kennedy during a campaign event in Las Vegas, Nevada.

“That was very nice,” the former president said, adding that Kennedy is a “great guy” and “respected by everybody.”

Kennedy drew speculation about withdrawing his candidacy and backing Trump in the days leading up to the Friday announcement. On Thursday, he filed the paperwork to withdraw his name from Arizona’s ballot, per Arizona Secretary of State Adrian Fontes in a post on X.

Kennedy has faced dwindling polling numbers and financial trouble for his campaign while undertaking a monumental task in getting on states’ ballots as an independent candidate. He initially ran as a Democrat but switched to an independent ticket in October 2023.

Kennedy — son of Robert F. Kennedy and the nephew of John F. Kennedy — is part of one of the most storied families in Democratic politics. Throughout his campaign, he amplified anti-vaccine conspiracy theories and was seen as a possible spoiler candidate.

Harris-Walz campaign chair Jen O’Malley Dillon said “for any American out there who is tired of Donald Trump and looking for a new way forward, ours is a campaign for you,” per a Friday statement in response to Kennedy suspending his campaign.

“In order to deliver for working people and those who feel left behind, we need a leader who will fight for you, not just for themselves, and bring us together, not tear us apart. Vice President Harris wants to earn your support.”

Meanwhile, Trump is set to speak in Glendale, Arizona, later Friday. His campaign said Thursday that a “special guest” would join him at the rally.

Robert F. Kennedy, Jr. Suspends His Presidential Bid, Endorses Trump

Native Vote 2024. Robert F. Kennedy, Jr., who was running for president as an Independent, announced on Friday afternoon at a news conference in Arizona that he has suspended his presidential campaign. 

He then endorsed former President Donald Trump, who praised Kennedy in an appearance on Fox News on Thursday. Kennedy said he met with Trump and his aides several times and learned they agreed on issues like border security, free speech and ending wars.

 “There are still many issues and approaches on which we continue to have very serious differences. But we are aligned on other key issues,” Kennedy said at a news conference 

Kennedy said he would remove his name from the ballot in 10 battleground states likely to determine the outcome of the election but would remain as a candidate in other states. This comes after his support continually dropped in polls. A Reuters/Ipsos poll early this month showed his national support had fallen to 4 percent. 

Kennedy’s endorsement of Trump was first revealed in a court filing the campaign made in Pennsylvania ahead of remarks he made in Arizona. The court filing was first reported by The Associated Press.The campaign requested that he be removed from the Pennsylvania ballot, though it wasn’t immediately clear that he was officially dropping out of the race. Shortly after, he sought to be removed from Arizona’s ballot. 

Kennedy says the decision to back Trump is “a difficult sacrifice for my wife and children.” His wife, the actress Cheryl Hines, has privately expressed concern about a potential endorsement, a New York Times reporter was told by several people close to Kennedy.

Earlier on Friday, Kennedy was polling about 5% of the vote nationwide. While Kennedy endorsed Trump, it is not clear if his supporters will automatically vote for Trump.

Wanting their votes, Harris-Walz 2024 Campaign Chair Jen O’Malley Dillon released this statement late Friday afternnon:

“For any American out there who is tired of Donald Trump and looking for a new way forward, ours is a campaign for you. In order to deliver for working people and those who feel left behind, we need a leader who will fight for you, not just for themselves, and bring us together, not tear us apart. Vice President Harris wants to earn your support.

“Even if we do not agree on every issue, Kamala Harris knows there is more that unites us than divides us: respect for our rights, public safety, protecting our freedoms, and opportunity for all.”  

Five of Kennedy’s siblings have released a statement on Instagram saying his decision to endorse Trump “is a betrayal of the values that our father and our family hold most dear.” His siblings, who have publicly disavowed his campaign since last year, conclude their statement: “It is a sad ending to a sad story.”
